Strengthening WA’s mental health laws

The Mental Health Commission (Commission) is progressing legislative reforms to strengthen Western Australia’s mental health laws in response to the Statutory Review of the Mental Health Act 2014 (Review Report).

The Mental Health Amendment Bill 2026 has progressed to the drafting stage, with the recommended amendments expected to be introduced into WA Parliament in the second half of 2026.

The amendments will focus on:

  • strengthening consumer rights;
  • improving access to culturally appropriate care for Aboriginal and Torres Strait Islander people; and
  • refining processes to improve experiences for both consumers and staff. 

These changes will ensure the legislation is contemporary, effective and supports the delivery of safe, high-quality mental health care in Western Australia.

In addition to the legislative changes, the Commission is also considering implementation requirements and non-legislative system improvements recommended in the Review Report.
