Tabling of Statutory Review of the Mental Health Act 2014

The Minister for Mental Health tabled the Statutory Review of the Mental Health Act 2014 and Government Response in Parliament on 16 April 2024.

Under section 587 of the Mental Health Act 2014  (the Act), the Minister for Mental Health is required to undertake a review of the operation and effectiveness of the Act as soon as is practicable five years after its commencement (the Act came into operation on 30 November 2015). 

The Government has prioritised legislative amendment in the areas of further enhancing consumer rights; enhancing access to culturally appropriate care for Aboriginal and Torres Strait Islander people; and refining existing processes.

It’s intended these legislative amendments will strengthen the way the Act is operationalised to help ensure mental health consumers are provided with the best possible treatment, care and support.

The Commission will now begin planning for the development of an Amendment Bill and consult with key stakeholders as the bill is drafted.
